End User License Agreement - Iris Themes Template Club
License Agreement: This End User License Agreement (EULA) is a legal agreement between Purple Iris Design & Publishing and the end user, whether an individual or entity. If you install the Software onto any electronic storage median you are agreeing to be bound by the terms of this licensing agreement. If you do not agree to be bound by the terms of this agreement then do not use this Software and destroy all copies in your possession.
License
a.) This EULA grants you, the End User, a non-exclusive, limited license to use Purple Iris Design's templates in accordance with the rules stated in the membership plan you purchased. Sub domains and main domains are considered as 1 domain. Your membership grants you the following rights:
1.) Iris Themes - 3 Month Membership grants you, the End User, the right to use 1 Purple Iris Design template on 1 domain. When your membership expires you may continue to use 1 template, acquired during your membership, on 1 domain.
2.) Iris Themes - 6 Month Membership grants you, the End User, the right to use 2 Purple Iris Design templates on 2 domains. When your membership expires you may continue to use 2 templates, acquired during your membership, on 2 domains.
3.) Iris Themes - 12 Month Membership grants you, the End User the right to use 4 Purple Iris Design templates on 4 domains. When your membership expires you may continue to use 4 templates, acquired during your membership, on 4 domains.
4.) Iris Themes Pro Membership grants you the End User the right to use an unlimited number of templates on an unlimited number of domains. After an Iris Theme Pro Membership expires, professional members need to renew their account if they want to continue to deploy templates to new clients.
Modifications
Code and Graphics: You are authorized to make any necessary modifications to the template code as needed to meet your specific purposes. You may not distribute the original or modified code without Purple Iris Design's permission.
Copyright Notice: You may not remove the copyright notice from the template code. You may, however, alter, remove or disable the copyright notice from the bottom of the template, visible in the Frontend of the website.
License Restrictions
a.) The End User may not sell, rent, sub-license, assign, transfer, lease, sublease, modify, translate, digitally transfer, disassemble, decompile, reverse engineer or create derivative works based upon the Software.
b.) The End User may not export this Software into any country prohibited by the United States Export Administration Act.
c.) Purple Iris Design & Publishing may terminate this license agreement if you fail to comply with this EULA. If this license agreement is terminated you must cease use of and destroy all copies of the Software in your possesion.
Ownership
The End User is granted a limited use license through this EULA to use the Software. Purple Iris Design & Publishing reserves all rights and ownerships of all materials contained in this software product as well as all content on Purple Iris Design, (www.purpleirisdesign.com). You may not claim intellectual or exclusive ownership to any of our content or products, modified or unmodified. This software is protected by United States Copyright and International Copyright laws.
Product Delivery
Upon successful receipt of your payment your membership will become active. You will receive an email confirming your membership and purchase information. If you do not receive this email confirmation within one hour please contact Customer Service at Purple Iris Design. You must provide a valid email address for communication purposes. Once your membership is active you may login to www.purpleirisdesign.com to access all available templates.
During the membership term, full access will be provided to the templates and the forum. After membership has expired, download access for templates is disabled, but template usage rights continue.
Purple Iris Design will provide a minimum of one new template each month.
Other Provisions
a.) Should any provision of this Agreement be held to be void, invalid, unenforceable or illegal by a court, the validity and enforceability of the other provisions shall not be affected thereby. If any provision is determined to be unenforceable, you agree to a modification of such provision to provide for enforcement of the provision's intent, to the extent permitted by applicable law. Failure of a party to enforce any provision of this Agreement shall not constitute or be construed as a waiver of such provision or of the right to enforce such provision. If you fail to comply with any terms of this Agreement, your license is automatically terminated and you must then destroy all copies of the Software in your possession.
Limited Warranty
a.) Purple Iris Design & Publishing warrants that, for a period of thirty (30) days, from the date of purchase, as shown on the receipt, if properly installed and operated on hardware and software for which it is designed, the Software will perform substantially in accordance with the instructions.
b.) Customer Remedies: At Purple Iris Design & Publishing's sole discretion, your remedy shall be:( i.) Downloadable Software: replacement of the defective Software through additional download. (ii.) Physical Software: repair or replacement of defective software. Owners of physical products can elect to receive replacements in the form of a download version of their product, although doing so will void their right to other remedies.
c.) To make a warranty claim, contact Purple Iris Design & Publishing at warranty. This Limited Warranty is void if failure of the Software has resulted in whole or in part from accident, abuse, misapplication or violation of this Agreement. In no event shall Purple Iris Design be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
Any replacement SOFTWARE will be warranted for the remainder of the original warranty period or fifteen (15) days, whichever is longer. This warranty allocates risks of product failure between Licensee and Purple Iris Design & Publishing. THERE ARE NO OTHER WARRANTIES. PURPLE IRIS DESIGN & PUBLISHING DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE SOFTWARE AND ITS INSTRUCTIONS. PURPLE IRIS DESIGN DOES NOT WARRANT THE PRODUCT TO WORK WITH 3RD PARTY COMPONENTS, MODULES OR EXTENSIONS. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, MAY HAVE OTHERS, WHICH VARY FROM JURISDICTION TO JURISDICTION. PURPLE IRIS DESIGN & PUBLISHING DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED, ERROR FREE OR MEET LICENSEE'S SPECIFIC REQUIREMENTS. THE WARRANTY SET FORTH ABOVE IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES WHETHER ORAL OR WRITTEN. THE AGENTS OR EMPLOYEES OF PURPLE IRIS DESIGN & PUBLISHING ARE NOT AUTHORIZED TO MAKE MODIFICATIONS TO THIS WARRANTY, OR ADDITIONAL WARRANTIES ON BEHALF OF PURPLE IRIS DESIGN & PUBLISHING. ADDITIONAL STATEMENTS SUCH AS ADVERTISING OR PRESENTATIONS, WHETHER ORAL OR WRITTEN, DO NOT CONSTITUTE WARRANTIES BY PURPLE IRIS DESIGN & PUBLISHING AND SHOULD NOT BE RELIED UPON.
d.) (USA ONLY) SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.
Refund Policy
All license fees are non-refundable. Purple Iris Design does not issue refunds for products that are non-tangible, downloadable goods.

Support is provided through tutorials, FAQs and the forum on Purple Iris Design, www.purpleirisdesign.com. If you cannot find an answer through one of the listed sources then email Customer Service. Purple Iris Design does not provide telephone support. Purple Iris Design does not commit to monitor the forum, but we reserve the right to respond and answer questions.
